What
is the Observatory
The Observatory is a forum for reflection and in depth study of
the security of on-line transactions. Its purpose, counting on
leaders in the Information Society, is to provide a solution
for government and private entities.
Short
History
Ever since the possibilities of the virtual world became
patented, the General Council of
the Profession of the public notary, along with the sixteen notary
associations that comprise the public notaries of all Spain, voiced the demand directed at the adaptation of the institutions and their
operation to new technological possibilities, making them compatible
with the public notary function. The public notaries
do not want to lose any of their characteristic functions, but
still gain agility, effectiveness and provide better service to
the public.
Activities
The bet for a modern public notary took shape
in the so called Technological Answer of the Profession,
completed later by the constitution of a Observatory with the purpose of evaluating the obtained progress, as well as elaborating
proposals of improvement and future projects of implantation and
technological development in the notarial profession. These initiatives
have come to modernize the activity of the notary through
the use of the new technologies: the electronic signature,
implanted in fulfilment of the Law 24/2001 has allowed making
reality the electronic public document; the centralization of
data, unifying and guarantying the secure use of the tools
and computer science processes. The creation of a private network
of notaries allows the immediate connection and communication
between the different offices. All this has concrete
applications of which the results can already be enjoyed by the public.
It is a reality that you can go to one of the three thousand
public notary offices in Spain, even in populations of hardly
two thousand inhabitants, and to observe the public notary using
his electronic signature and consulting the cadastral data of a building on-line and obtaining from the Virtual Office of the Cadastre
the corresponding plane, or communicating with the Mercantile Registry
and transfering the request of the name of the society that he wishes
to constitute or, even, in some cases, the shipment of the deed
of incorporation. It is also possible to directly send the
electronic copy of a power that was just signed in order
to use that same power in any other notary's office where the proxi is needed, without having to use postal service or mail.
